Welcome to Dreamala, a service provided by StudioD24 ("Company", "we", "us", "our"). Your use of the Dreamala web and mobile application (the "Service") is governed by these Terms of Service ("Terms"). Please read these Terms carefully before using our Service.
By using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service. We reserve the right, at our sole discretion, to make changes or modifications to these Terms at any time and for any reason.
You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you are 13 or older and that you are capable of understanding, accepting and complying with these Terms.
Each user must create an account to use our Service. You are responsible for protecting the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
By using our Service, you grant us permission to use your data to generate photos of your dreams using AI image generation tools. Your data will be handled in accordance with our Privacy Policy.
Our Service operates on a freemium model. This means that some features of the Service are available without charge ("Free Service"), while additional features or resources are available for a fee ("Premium Service"). Users of the Free Service are not required to make any payments and can use the Free Service unless their access is suspended or terminated due to a violation of these Terms or at our sole discretion. If you wish to use the Premium Service, you will need to pay the subscription fee.
You agree to pay all applicable fees related to your use of our Premium Service. We may suspend or terminate your access to the Premium Service if we do not receive full payment on time from you. Subscription fees are non-refundable except as required by law or as otherwise stated specifically in these Terms.
While our Premium Service offers an extended amount of dream logging and media generations, we expect our users to use the Service responsibly to ensure a positive experience for all users. We reserve the right to monitor usage of the Service to ensure fair use.
If we determine, in our sole discretion, that your use of the Service is excessively high, causing detriment to the performance of the Service for other users or our resources, we may adjust, limit or suspend your access to the Service.
We also reserve the right to suspend or terminate accounts, at our sole discretion, where we believe that the user is engaging in fraudulent activity or other activities that may have a detrimental effect on the Service, our network or our business reputation.
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of StudioD24 and its licensors. The Service is protected by copyright, trademark, and other laws of various countries.
In no event shall StudioD24, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
These Terms shall be governed and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
